40-Year Land Dispute Victory: Ulegun Community vs Ukhiri Community
Prince Eghosare Omoregie & 2 Ors v. Osanyade Godwin Aigbe & 3 Ors represents one of our most significant victories in land litigation. This case centered on a fierce land ownership dispute between Ulegun Community and Ukhiri 1 Community that began in 1976 and spanned over four decades.
This 40-year land battle demonstrates our commitment to seeing cases through to their logical conclusion, no matter how protracted. Our persistence delivered justice and substantial compensation for our clients.
The Subject Matter
The disputed land was located on both sides of the Benin/Abraka road in Benin City, Edo State, measuring an impressive 225.47 hectares. Ulegun Community engaged our services to protect their ancestral land rights against the claims of Ukhiri 1 Community.
Our Victory Across All Courts
We diligently prosecuted this matter and secured victory for our clients at the High Court, Court of Appeal, and even at the Supreme Court. Initially, damages worth over N2.5 million were awarded in favor of our clients at the lower court.
Reviewing the Damages Award
Recognizing that the initial award was inadequate given the magnitude of the dispute, we cross-appealed against the damages. The Court of Appeal agreed with our arguments and significantly increased the damages from N2,500,000.00 to N15,000,000.00 (Fifteen Million Naira). The opposition's appeal to the Supreme Court was subsequently dismissed on technical grounds.
